Novato High School has a student newspaper again seven years after a student's opinion piece on illegal immigration caused administrators to confiscate the paper, sparking a First Amendment lawsuit that went all the way to the U.S. Supreme Court.
The student, Andrew Smith, sued the district for infringing on his free speech rights and won. The school district fought him in state and federal courts for several years, but last week the U.S. Supreme Court refused to review a lower court ruling in favor of Smith, which ended the case. Smith was represented by the Pacific Legal Foundation, which called it a "precedent-setting victory against any attempt to impose ‘politically correct’ thought codes on student journalists in California.”
As the case moved through the courts, the student newspaper collapsed. But now the school's journalism club has brought it back to life, according to a report in the weekly Novato Advance. The club printed its first issue earlier this year and is working on a second one. Journalism club adviser Deborah Thompson called the first edition "lighthearted," a departure from the issue following 9/11 which was confiscated by school officials.

Fighting for your rights ain't cheap
Fighting for your First Amendment rights is a nice concept, but paying for it is another matter. The Pacific Legal Foundation spent $1.49 million fighting for the First Amendment rights of student Andrew Smith, who in 2001 wrote an article in the Novato High School student paper that was censored illegally by school administrators. The case went all the way to the U.S. Supreme Court. Now the California Court of Appeals in San Francisco has affirmed a decision that the school district, which violated Smith's rights, only has to pay $336,350 in attorney's fees instead of the $1.49 million sought by Smith's lawyers.

Court rules for student in free-speech case
A state appeals court ruled Tuesday that Novato school officials violated the free-speech rights of a student by condemning an opinion article he wrote in the student newspaper opposing illegal immigration and confiscating copies of the paper, the Marin Independent Journal reports.
The First District Court of Appeal held that California law “mandates that a school may not prohibit student speech simply because it presents controversial ideas and opponents of the speech are likely to cause disruption.”
The ruling reverses a 2005 decision by Marin County Superior Court Judge John Sutro that favored school officials and ordered that the student, Andrew Smith, and his father pay more than $20,981 in litigation costs to the Novato Unified School District. Smith, who now is a corporal in the Marine Corps reserves and is training in Thailand, claimed in his 2002 lawsuit that district officials denied his freedom of speech by apologizing to students and parents for the first article and confiscating remaining copies of the newspaper. He said his rights were violated when the district delayed publication of the second article by requiring a counterpoint article.
Tuesday's decision means that Smith will be given back litigation fees that he paid in 2005. He will be awarded nominal damages of $1.

State's high court backs student journalist
The California Supreme Court — in its third pro-media ruling in three weeks — has refused to hear the Novato school district's challenge of a ruling that upheld a student's right to write an anti-illegal immigration editorial for the student newspaper (Chron) (BCN). The school district was appealing a ruling in May by the Court of Appeal in favor of student Andrew Smith, who now attends Santa Rosa Junior College and is in the Marine Corps reserves.
Smith was a high school senior when his school paper printed his editorial on Nov. 13, 2001 that suggested people who can't speak English should be suspected of being illegal immigrants and that a number of undocumented immigrants are criminals. Student wins battle over immigration essay
The U.S. Supreme Court has let stand a lower court ruling in favor of a Novato high school student who sued when school administrators confiscated student newspapers containing an essay he wrote on immigration in 2001. Smith was represented by the Pacific Legal Foundation, whose Paul Beard II told the IJ that the Novato district filed a petition with the federal court even though the lower court ruling was based entirely on state law. The district asserted the federal court should weigh in anyway.
"Their petition to the U.S. Supreme Court was so frivolous we decided not to even respond," Beard said. "The (lower court) decision was based entirely on California law and the unique protection California law provides to students."
"The California decision is published and binding across the state right now," Beard told the IJ. "It makes California, probably, the most protective state for students - the federal is a much lower standard."

High school censorship case appealed
The ACLU, Student Press Law Center and a law firm have submitted a "friend of the court" brief with the California Court of Appeal in support of a high school journalism student who sued the Novato Unified School District in 2002 for censoring editorials he wrote about immigration and reverse racism. The articles were originally approved by the school principal, but after publication school officials confiscated copies of newspaper and said the editorials violated school policy after other students and parents complained about the content of the articles. The student, Andrew Smith (now a U.S. Marine), sued the school district. The Superior Court issued a ruling against him. Smith is now appealing that ruling. Christine P. Sun, attorney for the ACLU of Southern California, said the ruling, if not reversed, will almost certainly chill future speech by sending the message that school officials can prevent or punish students for publishing certain views. 2003 Peninsula Press Club awards
FOSTER CITY — Bay Area print journalists, photographers, radio and television personnel and public relations professionals were presented with 157 awards of excellence in 68 categories at the Peninsula Press Club's 26th annual Professional Journalism Awards dinner here tonight.
The Peninsula Press Club's annual Professional Journalism Awards Competition dinner was held at the Crown Plaza Hotel.
The winners were selected from 453 entries from media professionals in the 11 Greater Bay Area counties. Competition was for work done in 2002. Entries were judged by the Press Club of Cleaveland, Kern Press Club, Press Club of New Orleans, San Diego Press Club and the Press Photographers Association of Great Los Angeles.
Winners of $1,500 Herb Caen Scholarships were Mellissa Navas of Contra Costa College in San Pablo and Will Stevens of California High School in San Ramon. The Peninsula Press Club annually awards $1,500 scholalrships each to the winning college and high school journalism students. In addition, one-time awards of $1,000 each in memory of the late Mary Jane Clinton Zirkel, owner and long time Lifestyle editor of the San Mateo Times, were presented to Adva Saldinger of Aragon High in San Mateo and Aysha Pamukcu of Fremont High in Sunnyvale.

The Peninsula Press Club's annual Professional Journalism Awards Competition dinner was held at the Crown Plaza Hotel.
The winners were selected from 453 entries from media professionals in the 11 Greater Bay Area counties. Competition was for work done in 2002. Entries were judged by the Press Club of Cleaveland, Kern Press Club, Press Club of New Orleans, San Diego Press Club and the Press Photographers Association of Great Los Angeles.
Winners of $1,500 Herb Caen Scholarships were Mellissa Navas of Contra Costa College in San Pablo and Will Stevens of California High School in San Ramon. The Peninsula Press Club annually awards $1,500 scholalrships each to the winning college and high school journalism students. In addition, one-time awards of $1,000 each in memory of the late Mary Jane Clinton Zirkel, owner and long time Lifestyle editor of the San Mateo Times, were presented to Adva Saldinger of Aragon High in San Mateo and Aysha Pamukcu of Fremont High in Sunnyvale.

2011 Greater Bay Area Journalism award winners
FOSTER CITY — Bay Area print and online journalists, photographers, radio and television personnel and public relations professionals were presented with 204 awards of excellence in nine divisions and 37 categories at the San Francisco Peninsula Press Club's 34th annual Greater Bay Area Journalism Awards dinner tonight.
The San Francisco Peninsula Press Club's annual Professional Journalism Awards Competition dinner was held at the Crowne Plaza Hotel, Foster City.
The winners were selected from 523 entries from media professionals in the 11 Greater Bay Area counties. Awards honored work done in 2010. Entries were judged by the Press Clubs of Bakersfield, Florida, Houston, New Orleans, San Diego and Southeast Texas. The Print Photography division was judged by press photographers of the News Journal, Wilmington, Del., and was coordinated by Paul Sakuma of the Associated Press.
The big winner for the first time was Patch.com with 19 awards. The San Mateo Daily Journal followed with 15 and the San Jose Mercury News with 14. Cromwell Schubarth, Multi Meida/Research Editor of the Silicon Valley/San Jose Business Journal, received seven plaques.
The guest speaker for the event was Mike Sugerman, reporter, KPIX CBS 5 and KCBS Radio.
Two $1,500 scholarships in the name of the late San Francisco Chronicle columnist Herb Caen were awarded. The high school recipient was Steven Lau, California High School, San Ramon. The collegiate scholarship was presented to Kayla Figard, College of San Mateo.
Special recognition was given to the General Excellence winner of the Press Club’s High School Journalism Contest, The Campanile, Palo Alto High School. The Paly adviser, Esther Wojcicki, accepted a plaque.

2006 Greater Bay Area Journalism Awards
FOSTER CITY -- Bay Area print journalists, photographers, radio and television personnel and public relations professionals were presented with 226 awards of excellence in 90 categories at the Peninsula Press Club's 29th annual Greater Bay Area Journalism Awards dinner here tonight.
The Peninsula Press Club's annual Professional Journalism Awards Competition dinner was held at the Crowne Plaza Hotel, Foster City.
The winners were selected from 578 entries from media professionals in the 11 Greater Bay Area counties. Competition was for work done in 2005. Entries were judged by the Florida Press Club, Milwaukee Press Club, the Press Club of Cleveland, and the Press Club of Southeast Texas. The photography staff of the Oregonian, Portland, Ore., judged the photo entries coordinated by Paul Sakuma of the Associated Press.
Also, $3,600 in scholarships were presented. Two $1,500 scholarships in the name of the late San Francisco Chronicle columnist Herb Caen were awarded to Josh Hoffman, Burlingame High School, and Alexis Terrazas, College of San Mateo. A one time $600 scholarship in the name of the late Peninsula sportswriter Merv Harris was awarded to Emmanuel Padilla, Jefferson High School, Daly City.
San Francisco Chronicle reporter Kevin Fagan presented a short keynote on his award-winning "Shame on the City" series.

The Peninsula Press Club's annual Professional Journalism Awards Competition dinner was held at the Crowne Plaza Hotel, Foster City.
The winners were selected from 578 entries from media professionals in the 11 Greater Bay Area counties. Competition was for work done in 2005. Entries were judged by the Florida Press Club, Milwaukee Press Club, the Press Club of Cleveland, and the Press Club of Southeast Texas. The photography staff of the Oregonian, Portland, Ore., judged the photo entries coordinated by Paul Sakuma of the Associated Press.
Also, $3,600 in scholarships were presented. Two $1,500 scholarships in the name of the late San Francisco Chronicle columnist Herb Caen were awarded to Josh Hoffman, Burlingame High School, and Alexis Terrazas, College of San Mateo. A one time $600 scholarship in the name of the late Peninsula sportswriter Merv Harris was awarded to Emmanuel Padilla, Jefferson High School, Daly City.
San Francisco Chronicle reporter Kevin Fagan presented a short keynote on his award-winning "Shame on the City" series.

Legal fees disputed in school paper case
In a case that went all the way to the U.S. Supreme Court, the Novato Unified School District lost a First Amendment case brought by a student who claimed his essay was censored by the principal of Novato High School. But the Marin Independent Journal reports that the district is still battling over the legal fees in the 7-year-old case. The IJ reports that the law firm that successfully represented Andrew and Dale Smith, the former student and his father, filed an appeal claiming a Marin County judge shorted it $1.2 million in legal costs.

2010 Greater Bay Area Journalism Award winners
Bay Area print and online journalists, photographers, radio and television personnel and public relations professionals were presented with 167 awards of excellence in nine divisions and 36 categories at the San Francisco Peninsula Press Club's 33rd annual Greater Bay Area Journalism Awards dinner tonight.
The San Francisco Peninsula Press Club's annual Professional Journalism Awards Competition dinner was held at the Crowne Plaza Hotel, Foster City.
The winners were selected from 394 entries from media professionals in the 11 Greater Bay Area counties. Awards honored work done in 2009 Entries were judged by the Bakersfield Press Club, Milwaukee Press Club, the Press Club of New Orleans, and the Press Club of Southeast Texas. The Print Photography division was judged by press photographers outside of the Bay Area and was coordinated by Paul Sakuma of The Associated Press.
The San Jose Mercury News received 19 plaques followed by The Daily News with 18 and the Community Newspaper Group with 14. Tied with 13 each were the San Mateo Daily Journal and the Silicon Valley/San Jose Business Journal.
The guest speaker for the event was Jeanne Carstensen, managing editor of The Bay Citizen.
Four $1,500 scholarships in the name of the late San Francisco Chronicle columnist Herb Caen were awarded.
The high school recipients were Maritza Martin, Jefferson High School, Daly City, and Anca Ulea, California High School, San Ramon.
The collegiate scholarships were presented to Margaret Baum, College of San Mateo, and Richard Parks, University of California, Berkeley
Special recognition was given to the General Excellence winner of the Press Club’s High School Journalism Contest, The Colt Quarterly from El Camino High School in South San Francisco. Lauren Eberle, editor-in-chief, and Adam McLearan, adviser, accepted a plaque.
